20 years in jail for man accused of defiling street boy

A 24-year-old man has been sentenced to 20 years in jail for defiling a 13-year-old street boy.

Chief Magistrate Martha Mutuku ordered that Michael Mwakio start to serve the sentence from the time he has been in custody.

The court ruled that the case against the accused had been proved beyond doubt by the prosecution led by Principal Prosecution Counsel Alex Gituma.

In her ruling, Mutuku observed that the lengthy jail term will serve as a deterrent to those who may wish to take advantage of vulnerable children.

The accused is said to have lured a group of street children at night to his house in Tudor area with the promise to accommodate them instead of sleeping on the streets.

Later at the dead of the night, the accused would undress and defile one of them threatening to throw him in the sea, if he raised an alarm.

Another street boy woke up from his sleep and caught the accused in the act and alerted neighbours forcing the accused to escape.

He was arrested in the morning hours after resurfacing from his hideout and frogmarched to Makupa police station.

The accused was charged with defilement contrary to section 8(1) as read with section 8(3) of the sexual offences Act no.3 of 2006.

He was also faced with an alternative count of committing an indecent act with a child contrary to Section 11(1) of the Sexual Offences Act no 3 of 2006.

He committed the offences on 28 February 2022 at Tudor estate area in Mvita Sub County within Mombasa County.
