Former ICT Principal Secretary Sammy Itemere and his co-accused have been set free in a Ksh 122 million theft case.

This is after Milimani’s Chief Magistrate Lucas Onyina dropped charges on 13 accused persons after the Director of Public Prosecution Renson Mulele filed the application in a case where Kakamega Deputy Governor Ayub Savula is also charged.

The trial Magistrate concurred with the DPP’s request after reviewing the evidence against the 13 accused persons he established that the accused had no case.

So far, 13 prosecution witnesses have given their evidence with nine remaining who are to adduce their evidence from April 22nd.

The court further directed that the securities or cash bail placed by the accused persons be refunded to the depositors.

The prosecution applied to have the charge sheet amended to exclude the 13 who have been removed and also give a chance to the defense counsels to prepare for their defense on the remaining nine prosecution witnesses.

The request was allowed by the court.

Savula and his co-accused allegedly stole Ksh 122 million in Government advertising.
