Father risks land to bail out daughter charged with murder

A small-scale farmer has been forced to deposit a title deed for a Ksh 2 million piece of land at the Eldoret High Court as surety for his 35-year-old daughter accused of stabbing her husband to death. 

Francis Maina, father to the accused, Winnie Maina, assured Eldoret High Court Presiding Judge Reuben Nyakundi that he will make sure the daughter does not abscond court proceedings when needed once the hearing of her case kicks off.

The man from Murang’a told the court that he was ready and willing to take the risk by offering his land title deed as security to secure the release of his daughter from Eldoret women GK remand prison, where she has been held for over one year.

“Your honour, I will ensure my daughter attends all court proceedings when needed by the court without failure and that is why I have taken the risk to stand surety for her using my title deed,” assured Maina.

This was after being warned by the judge that the government would auction his property in the event his daughter who was arrested on August 21st, 2022, turns out to be a flight-risk once released from remand.

“Now that you have accepted to help your daughter secure her freedom pending hearing of her murder case, it will be upon you to ensure that she does not at any time abscond court proceedings when needed,” cautioned Justice Nyakundi.

The accused was arraigned in court for allegedly inflicting injuries to her 33-year-old husband, Wycliffe Mirit who died at the Moi Teaching and Referral Hospital Eldoret while undergoing treatment.

She denied killing the deceased, who was a senior logistics officer at an international beverage company based in Eldoret, in an incident that happened after a night-long partying, at their Elgon View estate in Uasin Gishu County.

According to the police report presented to the court, the accused rushed her husband to MTRH, after stabbing him three times. Still, he succumbed to the injuries upon arrival at the hospital.

A security guard at the Elgon View estate where the couple lived told police detectives that the duo arrived at their house from a local pub at around 4.30 a.m. on the fateful Monday, August 22 before a fight erupted.

The guard, Geoffrey Rono attached to G4 Security Company, reported the incident to the Langas police station.

The police then launched a search and arrested the suspect at the hospital where she had rushed her husband for treatment.

Justice Nyakundi ruled that the case be heard on November 1st and 2nd, 2023.
